Intention to sell plot of land at Rijksstraatweg 72-76 in Hurdegaryp

The municipality of Tytsjerksteradiel intends to sell the plot of land located at Rijksstraatweg 72-76 in Hurdegaryp, known in the land registry as municipality of Hardegarijp, section A, number 8235 (in part), measuring approximately 178 m² (hereinafter referred to as: the "Property"), to OWC Harns Invest – Kuin B.V. The sale price of the plot is €44,250, excluding sales tax.

Based on objective, reasonable, and verifiable criteria, the municipality has determined that only one serious candidate is eligible to purchase the Property. The other party is the owner of the adjacent plot and wishes to use the Property for residential development. On this basis, the municipality has concluded that the current other party is the only serious candidate.

Do you disagree with this decision?

If you believe that you too should be eligible to purchase the Property on the basis of the criteria set out above, you must initiate summary proceedings before the preliminary relief judge of the District Court of Northern Netherlands, Leeuwarden location, within 20 calendar days of this publication, i.e. no later than February 10, 2026. This period is a deadline. 

If no preliminary relief proceedings are instituted, the right to take legal action against all of the above and/or to base any claim for compensation or any other claim whatsoever on it will lapse, or at least you will have forfeited your rights to do so. After all, the municipality and the candidate would be unreasonably disadvantaged if the intention to sell were to be challenged only after this clearly stated period.
