Green spaces and residual land, buy or rent
The Municipality of Tytsjerksteradiel owns a lot of land along roads and paths. This land is usually intended for public use and is therefore not for sale. Sometimes the municipality also owns land that does not have a public function. In those cases, the municipality can sell the land.
How does it work?
Would you like to buy or rent land from the municipality and want to know if you qualify? Email the Department of Development and Advisory Space at gemeente@t-diel.nl. In the mail, put your name, address and phone number and indicate as clearly as possible which land you would like to buy (next to, in front of or behind your home and how many meters). If possible, for clarification, please attach a situation sketch to your message. As soon as we receive your request we will assess it. You can also call us at telephone number 14 0511 (without the area code).
How long does it take?
Reviewing your request will take approximately 2 to 6 weeks. If your request is denied, you will be notified in writing. If granted, you will receive a written offer.
Terms
We only sell public green spaces if the space in question is not of public interest and we are still able to maintain the surrounding green spaces. For example, the sale of public green spaces is not permitted in the following cases:
- If this adversely affects the space between the private lots.
- If this has a negative impact on the functions of public green spaces mentioned above.
- If this results in jagged property lines or fragmentation (street layout).
- If the green space is located between playgrounds and gardens (to prevent disturbances).
- If greenery is located along public paths between gardens (to prevent the formation of alleys and preserve urban design quality).
- When green space borders green space that serves an ecological function (as a buffer).
- If there are trees in it.
- If the greenery contributes to traffic safety (by ensuring visibility).
- If the green space borders rental properties and the landlord does not want to buy it.
- If there are streetlights in them (we do not want to allow streetlights in gardens).
- If there are sewer or storm drain connections on the property (we do not want to allow sewer or storm drain connections in gardens).
- If there are cables and pipes in the green space in question, we may still decide not to proceed with the sale. Even if we are willing to proceed with the sale, this can only be done if a property right is established for the owner of the cables and pipes.
- Ensuring that space remains available for utility infrastructure (e.g., upgrading the electrical grid and associated transformers).
The above list is not exhaustive. There may be other reasons why the public green space in question is in the public interest.
When evaluating a request to purchase public green space, other policies—such as the Land Policy Memorandum—are also taken into account. Based on other policies, the municipality may also reject a request for a reason not mentioned in the Green Policy Plan.

Are you renting a property?
If you are not an owner but a tenant of the property, you cannot buy the land. In this case, the municipality will assess whether you may rent the land.
Land put into use
In the past, some green spaces have been withdrawn from public view because these spaces have been converted into gardens/yards by adjoining owners. This often happened with the permission of the municipality. Some of these strips are still of public interest, because sewers or cables and pipes lie underneath them.
Sometimes hedges/fences or other items belonging to landscaping are placed close to the road or are on top of sewers and get in the way when the municipality needs to access them. The strips that are of public interest, the municipality wants to furnish as such.
