Green areas and residual land, buying or renting

The municipality of Tytsjerksteradiel owns a lot of land along roads and paths. This land is usually intended for public use and is therefore not for sale. Sometimes the municipality also owns land that does not have a public function. In those cases, the municipality may sell the land.

How does it work?

Would you like to buy or rent land from the municipality and want to know if you are eligible? Email the Department of Development and Spatial Advice at gemeente@t-diel.nl. Include your name, address, and telephone number in the email, and indicate as clearly as possible which land you would like to buy (next to, in front of, or behind your home and how many meters). If possible, you can add a site sketch to your message for clarification. As soon as we have received your question, we will assess it. Calling telephone number 14 0511 (without area code) is also possible, of course.

How long does it take?

It takes approximately 2 to 6 weeks to assess your request. If your request is rejected, you will receive a written notification. If approved, you will receive a written offer.

Conditions

In the following cases, the sale of green areas is excluded:

  • Green areas that are part of a larger whole
  • Greenery between playgrounds and gardens
  • Greenery along public paths between gardens
  • Greenery adjacent to greenery with an ecological function
  • Greenery containing valuable trees
  • Greenery that contributes to traffic safety
  • Greenery adjacent to rental properties
  • Greenery in zoning plans after 1993
  • Greenery containing lampposts
  • Greenery containing sewers
  • Narrow strips of public green space containing cables and pipelines can only be sold if an easement is established on them. If there are many or heavy cables in the relevant strip of land, we may still decide not to proceed with the sale.

The municipality will not sell the land if any of these points apply.

Allocation procedure

The procedure for issuing public green space is described in an issuance protocol; more information about this can be found in Chapter 11. You can also consult this issuance protocol under Documents at the bottom of this webpage.

Do you rent a home?

If you are not the owner but the tenant of the property, you cannot buy the land. In that case, the municipality will assess whether you are allowed to rent the land.

Land taken into use

In the past, some green areas have been withdrawn from the public domain because these areas have been used as gardens/yards by adjacent owners. This often happened with the permission of the municipality. A number of these areas are still of public interest because there are sewers or cables and pipes underneath.

Sometimes hedges/fences or other parts that belong to the garden design are placed close to the road or are on top of the sewerage system and are in the way when the municipality needs access. The municipality wants to design the areas that are of public interest as such.

How much does it cost?

You can read how the municipality deals with prices for the sale and rental of land in the Land Valuation Policy 2025 - Municipality of Tytsjerksteradiel. You can consult this document under Documents at the bottom of this page.
