Temporary rental of vacant property

What is it?

The Vacancy Act allows you to temporarily rent out your vacant home or building. For example, if your home or office building has been for sale for some time or is going to be demolished. You must apply for a permit from the municipality for this.

How much does it cost?

Applying for a permit costs €63.90.

How does it work?

Please note! Is your current permit for your house for sale valid for less than 5 years? Then you do not need to extend it. Your permit is still valid for 5 years. You can ask the municipality to confirm this.

Please indicate the following on the application form:

  • your personal data;
  • information about the building or home you want to rent out;
  • details of the tenant;
  • description of the space you want to rent out;
  • the reason for your application;
  • or you have a permit based on the Housing Act, such as a withdrawal permit or division permit.

Conditions

You can apply for the permit for the following vacant buildings:

  • a home that is for sale and has never been inhabited;
  • a home that is for sale and in which the owner lived in the 12 months before it became vacant;
  • a home that is for sale and has been rented out for no more than 3 years in the past 10 years;
  • a rental property that is being demolished or renovated;
  • a building that is not built for residential purposes (for example, an office, school, building for group accommodation).

How long will you receive the permit?

  • House for sale: 5 years;
  • Rental property that is being demolished or renovated: 2 years (extension to a maximum of 7 years);
  • Living space in an office, school, or group home: 2 years (extension up to a maximum of 10 years);
  • Living space for which you have an exemption from the zoning plan: for as long as the exemption lasts (maximum of 10 years).

Rules

Have you been granted a permit for temporary rental? Then the normal rules for rent protection usually do not apply. However, the rules from the Vacancy Law: do apply.

  • The tenant has no tenancy protection when the lease ends;
  • The rental agreement lasts at least 6 months;
  • The tenant has a notice period of at least 1 month;
  • The landlord has a notice period of at least 3 months;
  • The rental agreement ends when the vacancy permit expires.

Rental price

If you receive a permit to rent out your home that is for sale, you may agree on the rental price together with the tenant. In all other cases, the rental price may not be higher than the price stated in the permit.
