Request for enforcement

You want to inform the municipality that you are experiencing a nuisance. Or you think that the municipality's rules are not being followed. By submitting a report or submitting a request for enforcement, you can inform the municipality of this.

Report

Reports can be made about, for example, litter or nuisance from catering establishments or companies. In principle, a report can be submitted for everything. Also, a report/complaint can be submitted for, for example, conflict with the zoning plan, illegal constructions, illegal habitation, destruction of alder hedges and other (alleged) conflicts. The municipality decides whether to take action on your report, but does not take a formal decision on this. Your reports give us insight into the nature and extent of the nuisance, so that we can act more effectively.

Request for enforcement

You can submit a request for enforcement if you suspect that the municipality's rules are not being followed. This must concern situations that are in violation of laws and regulations. The municipality will take a formal decision on your request, against which you can lodge an objection and appeal.

How does it work?

A request for enforcement must comply with the provisions of the General Administrative Law Act (Awb).

  • You must have a direct interest in the enforcement of the rules. For example: the terrace of the café next to your home is still open after closing time, or a company is producing more noise than is permitted.
  • The violation occurs regularly. According to you, reporting a nuisance is not enough to tackle the problem.
  • You can submit a request for enforcement by post or online. If you wish to submit your request by post, please send your letter to: Gemeente Tytsjerksteradiel, Postbus 3, 9250 AA Burgum, if the violation occurs within our municipality.

  • You must submit the request:
    • submit under your own name and with your own address and place of residence details (requests for enforcement cannot be submitted anonymously);
    • include a date;
    • include a description of the alleged violation and by whom the violation is committed;
    • include a description of your direct interest involved in the violation;
    • include a description of exactly what you expect from us.
