Request for enforcement
You want to let the municipality know that something is bothering you. Or you think that the rules of the municipality are not being followed. You can notify the municipality by filing a report or requesting enforcement.
Notification
For example, reports can be about litter or nuisance from the hospitality industry or businesses. In principle, a report can be submitted for anything. A report/complaint can also be submitted about conflicts with the zoning plan, illegal buildings, illegal occupation, destruction of alder bushes and other (alleged) conflicts. The municipality decides whether to act on your report but does not make a formal decision. Your reports give us insight into the nature and extent of the nuisance so that we can take more targeted action.
A notification is subject to these rules:
- You can file a report with Fixi.
- You can make a report by phone at 14 0511.
Request for enforcement
You can request enforcement if you suspect that the rules of the municipality are not being followed. These must be situations that violate laws and regulations. The municipality will make a formal decision on your request, against which you can object and appeal.
How does it work?
A request for enforcement must comply with the provisions of the General Administrative Law Act (Awb).
- You must have a direct interest in enforcing the rules. Example: in the café next to your home, the terrace is still open after closing time or a business produces more noise than is allowed.
- The violation occurs regularly. Filing a living environment report is not sufficient to address the nuisance, in your opinion.
- You submit a request for enforcement by mail or online. Would you like to submit your request by mail? Then send your letter to Gemeente Tytsjerksteradiel, Postbus 3, 9250 AA Burgum if the violation occurs in our municipality.
- Would you like to submit your request online? You can do so using the online Request for Enforcement form.
- You must make the request:
- under your own name and with your own address and residence information (filing a request for enforcement cannot be done anonymously);
- provided with a date;
- provided with a description of the alleged offense and by whom the offense is committed;
- provided with a description of your direct interest involved in the violation;
- provided with a description detailing exactly what you expect from us.
