Intention to sell subarea 4 It Sud phase III, Hurdegaryp

The municipality of Tytsjerksteradiel has the intention, within the municipal housing project It Súd, phase III in Hurdegaryp, to sell two plots of building land located near Easter Omwei/It Waarlamke in Hurdegaryp, cadastral name municipality of Hardegarijp, section H, number(s) 2549, with a size of approx. 1,205 m² and 1,100 m² respectively (hereinafter together referred to as the "Immovable Property"), at a social land price of € 100 per m2 excl. VAT to be sold to Stichting WoonFriesland for the purpose of social housing construction.

Further motivation

The Municipality is of the opinion that, based on objective, reasonable and reviewable criteria, there is 1 serious candidate eligible to purchase the Immovable Property. 

Housing Associations To this end, the municipality argues the following objective, testable and reasonable criteria: 

  • The Municipality of Tytsjerksteradiel fully owns the plan area.
  • On Jan. 28, 2025, the spatial preconditions for It Súd, phase III were adopted by the municipality containing a housing program with 55 homes including 16 social housing units.
  • WoonFriesland is active as a housing corporation in the municipality of Tytsjerksteradiel, including Hurdegaryp and is exclusively active in the field of public housing. As a housing corporation WoonFriesland is committed to people who, based on their income or personal situation, cannot provide housing on their own. WoonFriesland does this by offering affordable rental housing.
  • WoonFriesland is an approved institution under the Housing Act and regulations, which are subject to external (government) supervision for the performance of their statutory housing tasks.
  • In accordance with the current performance agreements (2024-2028), the Municipality of Tytsjerksteradiel, and WoonFriesland are each other's primary partners when it comes to realizing social housing within the Municipality of Tytsjerksteradiel.
  • In accordance with the current Target Groups Ordinance (2023) of the Municipality of Tytsjerksteradiel, the rental housing to be realized must be available for social rent for the target group for 25 years and these social rental housing units must have at least a living area of 50 m² of usable area.

Do you disagree with this decision?

If you are of the opinion that, based on the aforementioned criteria, you too should be eligible to purchase the Immovable Property, you must commence preliminary relief proceedings with the Interim Injunction Judge of the District Court of Noord-Nederland, Leeuwarden session location, within a period of 20 calendar days (i.e., no later than October 21, 2025) after this publication. This period is an expiry period. 

In the absence of the commencement of summary proceedings, the right to take legal action against all of the aforementioned and/or to base any claim for damages or any other claim whatsoever thereon lapses, or at least you have processed your rights thereon. After all, the Municipality and the prospective buyer would be unreasonably disadvantaged if the intention to sell were to be contested only after this clearly stated deadline.
